Environmental Information Regulations
A Practical Guide

Susan Wolf

Overview

This comprehensive guide provides much-needed coverage of the Environmental Information Regulations 2004, which impose obligations on a wide range of organisations and bodies.

Written by an expert in the field, the book is aimed at information rights practitioners and those in public authorities charged with making decisions about the disclosure of environmental information. It provides valuable guidance for applicants and prospective applicants. The coverage includes:

  • an outline of the background and purpose of the Regulations with reference to the Aarhus Convention and the EU Council Directive 2003/4 on Public Access to Environmental Information
  • examination of the Regulations' provisions, including the DEFRA and other relevant guidelines
  • discussion of the practical aspects of the Regulations including the definition of environmental information, the bodies subject to obligations, time limits, fees and charges, and exceptions to the duty to disclose
  • analysis of the relationship between the Environmental Information Regulations and related legislative provisions such as the Freedom of Information Act and the Contaminated Land and Town and Country Planning Public Registers
  • all relevant case law and decisions of the Information Commissioner and Information Tribunal.
